FACT: Horizontal property (condominium) in Cape Verde is governed by the Civil Code and was reformed by Law no. 57/X/2025 of 5 August (Boletim Oficial, I Series no. 70), in force since 6 August 2025. The regime defines the constitutive title, the autonomous fractions and the common parts. How it works: • FACT - Each condominium owner exclusively owns their autonomous fraction and co-owns the common parts (entrances, stairs, roof, lifts, etc.). • Quotas/charges - As a rule, the costs of maintaining and using the common parts are shared among the owners in proportion to the value of their fractions. Confirm the criteria in the constitutive title and the condominium rules. • Administrator - FACT - manages the common parts, collects the quotas and carries out the decisions of the owners' assembly. Law no. 57/X/2025 clarified the administrator's powers and now allows electronic convocations and deliberations, and lowered the threshold to amend the title to an absolute majority (previously unanimity). Condominium debts when buying (PRACTICE - confirm): • Unpaid quotas are a risk for the buyer: they can cause disputes and, depending on the applicable rules, affect the fraction.
